A will specifies who will be the executor to carry out a person's wishes, determines who will provide the care of any young children, and outlines how property and assets will be divided.
"Dying without making a will can cause unnecessary grief for family and may provoke fights in areas where there is doubt over the estate," said the founder of the Law Office of Michael T. Huguelet, P.C.
"Dying intestate could result in the probate court allocating assets in a way a person never intended. While we can't control every aspect of our lives, we can control what happens to our assets. Estate planning will help avoid any room for argument."
Estate planning should include detailed health care and financial powers of attorney, and he advised consulting a specialized lawyer as part of this process.
Mr Huguelet said: "A Health Care Power of Attorney with healthcare directives is vital when a person cannot make medical decisions. It allows a nominated person (your Healthcare agent) to make those decisions on your behalf, based on your written instructions.”

He recommended listing an alternate person as both an executor and/or agent under the Powers of Attorney if the first choice, usually a spouse or child, cannot fulfill the role.
